Cal OSHA News
“Every California Employer shall establish, implement, and maintain an effective Injury and Illness Prevention Program. The program shall be in writing.”
REF:California Code of Regulations, Title 8, Section 3203
Due to a recent court ruling, Cal/OSHA can no longer exclude small employers from required State Programs. All employers are now required to have four basic safety programs:
Injury and Illness Prevention Program
Hazard Communication Plan
Emergency Action Plan
Fire Prevention Plan
Not having these four programs can cost you up to $16,000.
“On October 6, 1999, AB 1127 changed Labor Code Section 6428 to require that if a violation is serious, the employer shall be assessed a civil penalty of up to $18,000 for each violation.”
The cost of not complying with Cal/OSHA requirements has gone up dramatically.Yet most employers don’t even know what is required.Who has time to keep up with ever-changing State & Federal Laws?Yet without a well-documented IIPP you will be unable to use the Employer Independent Action Defense and can be subject to both greater fines and possible follow up visits.
“To meet the challenge of effectively implementing the provisions of AB 1127, the Cal/OSHA Program will need to augment its compliance personnel resources at the District level in 2000.”
That’s not good news.Neither is “The increase in the number of complaints which must be categorized as formal,” and “the effect of the increases in civil penalties for serious, repeat, and failure-to-abate violations.”Yet all these things are now law in AB 1127.
