WAYS Cal/OSHA MAY MAKE
A VISIT TO YOUR ORGANIZATION
EMPLOYEE COMPLAINTS
· The most common method.
· Usually takes within a 4-month period for Cal/OSHA to make an unannounced visit to the employer.
· The employer may receive a letter from Cal/OSHA (DOSH).
· The employee filing the complaint may also receive a letter from Cal/OSHA (DOSH).
· Upon making a visit from a Cal/OSHA Compliance Officer, the employer will receive a letter from Cal/OSHA to abate the violation.
· Abatement usually takes approximately 30-60 days.
· Employer is required to inform Cal/OSHA the compliance of the abatement.
· Employee filing the complaint is protected under current both Fed/OSHA and Cal/OSHA Law (Whistleblower Protection Act) and is not required to inform his/her employer.
· Employer will be found liable if the employer tries to “fire” the employee filing the complaint.
Cal/OSHA HIGH HAZARD EMPLOYER PROGRAM (HHEP)
· Promulgated as of the result of the passage of AB 110 (passed in 1995).
· Employer will be effected and is under the program if their Workers’ Compensation Insurance “Experience Modification Factor” or “Ex-Mod” is above 1.25 or 125%.
· Employer may receive a letter from Cal/OSHA of monies to collect in order to fund the Program.
· Cal/OSHA will provide several options to the employer in order to begin reducing accidents in the workplace (i.e., Cal/OSHA Consultation Services or Workers’ Compensation Loss Control Consultation Services).
· Usually takes within a 2-3 month period for Cal/OSHA to make an unannounced visit to the employer.
Cal/OSHA TARGETED INSPECTION PARTICIPATORY PROGRAM (TIPP)
· Garment Industry
· Agriculture Industry
· Electroplating Industry
WORKPLACE FATALITY OR DEATH
· Employer is required to report the workplace fatality within 8 hours of their knowledge to the nearest Cal/OSHA Office.
· Usually takes within a 24-48 hour period for Cal/OSHA to make an unannounced visit to the employer.
